Court Kicks Out MP Kantinti, Orders Fresh Elections

Kampala. On April 26, 2017, the Court of Appeal threw out Kyadondo MP, Hon. Apollo Katinti out of Parliament following the petition that was filed by the NRM candidate Sitenda Sebalu who was the former area MP.
Court of Appeal Justices, Hon. Justice Paul Mugamba, Hon. Justice J Cheborion Barishaki and Hon. Justice Richard Buteera found that there was noncompliance of the electoral laws which substantially affected the results.They explained that a careful re-evaluation of the evidence on record had indicated that that there was ambiguity on the winner of the election.
The Justices added that with results from nine polling stations having not been included in the final tally, over 5,000 voters had been disfranchised.The electoral commission was ordered to conduct fresh elections in the constituency.
The High Court last year kicked out of Parliament the Kyadondo East constituency MP Hon. Apollo Kantinti (FDC) after court in its findings,discovered that there was non-compliance with election rules during the February 18 parliamentary elections in that constituency. The presiding Judge, Hon. Justice Isabirye Kaweesa ordered the Electoral Commission to organise fresh elections in Hon. Kantinti's constituency.
While nullifying Kantinti's election, Hon. Justice Kawesa faulted the Wakiso District returning officer Ms Sarah Bukirwa for disfranchising the voters and also failing to secure custody of election materials.
The ruling followed a successful petition to court by NRM's William Sitenda Sebalu who had been beaten in the February 18 election by Kantinti by a small margin of 326 votes.
